02 · Bail process

How Bail Bonds Work in Clear Lake

The usual path after a Clear Lake arrest. Every case is different; the court makes the decisions and no release time is guaranteed.

  1. 01

    Step 1 of 6

Arrest or Citation in Clear Lake

An incident in Clear Lake may end with a citation, a summons or an arrest. The Sherburne County Sheriff's Office is the city's listed law-enforcement resource, though the State Patrol or another agency can be involved — and the arrest location and custody location can differ.

  2. 02

    Step 2 of 6

Confirm Custody and Relevant Holding Facility

Many people held after a Sherburne County arrest go to the county jail in Elk River, but not everyone is booked, and an arrest by another agency or across a county line can mean a different facility. Check the official inmate search and call the jail if needed.

  3. 03

    Step 3 of 6

Verify Court-Set Bail and Release Conditions

A judge decides whether money bail applies and what release conditions must be followed. Some people are released without any bond at all.

  4. 04

    Step 4 of 6

Contact GPS and Review Authorized Bond Options

Once custody and the court's terms are known, GPS can explain whether an eligible surety bond is available and what it would involve.

  5. 05

    Step 5 of 6

    Complete Premium, Paperwork and Underwriting

Expect the approved premium, identification, signed agreements and, when needed, a cosigner or collateral.

  6. 06

    Step 6 of 6

Post the Bond When Authorized and Follow Court Requirements

If the bond is approved and permitted, it is posted under the applicable procedure. Jail processing, other holds and court authorization all affect timing — no release time is promised. Every court date and condition must be followed.

Bail Bond Services in Clear Lake

Each statewide GPS guide explains how bail works for that charge in Minnesota. The same guidance applies to a Clear Lake arrest.

Not every charge is eligible for bail, and no amounts are guaranteed — the court decides in each case.

05 · Costs

What Bail Bonds Cost in Clear Lake

Clear Lake does not have a separate city bail bond premium schedule. The applicable court determines monetary bail and release conditions, while Minnesota's approved filed-rate and statutory rules govern commercial surety premiums.

Court-Set Bail vs. Bond Premium

The court sets the bail amount. Paying it directly in cash is one option. A surety bond instead costs a premium — a fee paid to the bail bond agency that is not returned at the end of the case.
Minnesota Criminal Procedure Rule 6 (opens an external site)

Filed Surety Rates & Minimum Upfront Payment

Under Minn. Stat. §60M.02, premiums follow rates filed with the Minnesota Department of Commerce. Bonds of $10,000 or less require at least 50% of the premium collected before posting; bonds greater than $10,000 require at least 30% collected before posting. Any unpaid premium balance requires the applicable approved, signed promissory note and the statutory repayment terms. The statutory minimum premium remains $100.
Minnesota §60M.02 — Bail Bond Premiums (opens an external site)

Promissory Note & Repayment

Any unpaid premium balance is put in writing, with a payment schedule and any allowed interest. The signer is responsible for that balance regardless of how the case ends. The same §60M.02 rules above govern premium payment.

Collateral & Cosigner Responsibilities

Some bonds require collateral or a cosigner. Minn. Stat. §60M.03 governs how collateral is held and returned. A cosigner may owe the full bond if the defendant misses court.

  • Locating a Clear Lake Arrestee

Begin with the Sheriff's official inmate search, then call the jail to confirm. Someone arrested near Clear Lake by another agency, or across the Stearns or Benton line, may be held somewhere else.

  • County Jail Booking

Booking includes identification, photographs and records checks, so a new arrest may not appear online right away. A citation alone does not mean someone was booked.

  • Official Inmate Search

The Sheriff's Office maintains the official jail roster. GPS is independent of that database and cannot change or add to it.

  • Bail and Release Conditions

The court may release someone, add conditions or set money bail. Conditions such as no-contact or testing terms must be followed even after a bond is posted.

  • Cash Bail vs. Surety Bond

Cash bail paid directly to the county is not the same as a surety premium paid to GPS. For direct cash bail only, the Sheriff's Office says it can be posted at Door D, 24 hours a day, with the exact cash amount and a government-issued photo ID — that procedure does not define how GPS accepts payment.

  • Probation and Other Holds

A probation hold, warrant or another county's case can keep someone in custody even after bail is posted on the Clear Lake matter. See our Warrant and Probation Violation guides.

  • Court dates

    Court Appearance Information

Some case details and hearing dates can be checked through Minnesota Court Records Online, but not every hearing appears publicly, and MCRO is not a jail roster or a complete warrant check. Pending criminal cases without a conviction generally won't appear in a defendant-name search; a case-number search may find records a name search doesn't. Court records are separate from jail custody information. Release paperwork lists the next court date — every appearance is required. Public court calendars can change and are not a substitute for confirming the person's required appearance directly.

09 · About

About Clear Lake, Minnesota

  • Clear Lake is a city in western Sherburne County, where U.S. Highway 10 meets Minnesota Highway 24 — the route that crosses the Mississippi toward Clearwater and Wright County.
  • Its place on the Highway 10 corridor ties it to Becker to the east and the St. Cloud area to the northwest, so travel and arrests here can cross agency and county lines.
  • City Hall on 1st Avenue West runs city services and local government. It is not a jail, a court or a bail counter.
  • Clear Lake Township, which surrounds the city, is a separate local government. Both rely on the Sherburne County Sheriff's Office, and cases from either go to the same county jail and District Court in Elk River.
  • Because Clear Lake is near the county's western edge, the first step after an arrest is confirming which agency made it and which facility is holding the person — usually the Sherburne County Jail, but not always.
