Understanding the charge
What Is Domestic Assault in Minnesota?
- Minn. Stat. §609.2242 makes it a crime to commit certain assaultive acts against a family or household member.
- It covers an act done with intent to cause fear of immediate bodily harm or death.
- It also covers intentionally inflicting, or attempting to inflict, bodily harm.
- The other person must fit Minnesota's legal definition of a family or household member.
- Qualifying prior domestic violence-related convictions can raise the charge level.
- A domestic relationship alone does not make a case a felony — more serious allegations may fall under other statutes.
Statute information
Minnesota Domestic Assault Charges and Penalties
Minnesota grades domestic assault by qualifying prior history, and treats strangulation as a separate felony. The charge level is separate from the bail decision.
Minn. Stat. §609.2242, subd. 1
Misdemeanor Domestic Assault
- An act intended to cause a family or household member fear of immediate bodily harm or death
- Or intentionally inflicting, or trying to inflict, bodily harm on them
- Classification
- A misdemeanor.
- History & circumstances
- The base offense, when no prior-conviction enhancement is charged.
- Bail is separate
- The charge level does not set the bail. A judge decides release under Minn. R. Crim. P. 6.02 and §629.72, weighing safety and court-appearance factors in the individual case.
- Confirm current bail
- Confirm the exact charge, any bail amount and every court order (such as a DANCO) with the jail, the court or the county's official inmate search.
The court may release on conditions; a commercial bond is not automatically required.
Minn. Stat. §609.2242, subd. 2
Gross Misdemeanor Domestic Assault
- A misdemeanor domestic assault
- Within ten years of one prior qualified domestic violence-related conviction or juvenile adjudication
- Classification
- A gross misdemeanor.
- History & circumstances
- "Qualified domestic violence-related offense" is defined in §609.02, subd. 16. Some out-of-state offenses count.
A prior arrest alone does not count — the enhancement needs a conviction or adjudication.
Minn. Stat. §609.2242, subd. 4
Felony Domestic Assault
- A domestic assault, or a fifth-degree assault under §609.224, subd. 1
- Within ten years of the first of two or more prior qualified domestic violence-related convictions or adjudications
- Classification
- A felony.
- History & circumstances
- Felony status depends on qualifying convictions inside the ten-year window — not a simple "third arrest" rule.
Felony cases usually get closer court and underwriting review. Bond approval is never guaranteed.
Minn. Stat. §609.2247
Domestic Assault by Strangulation
- Assaulting a family or household member by strangulation
- Strangulation: intentionally impeding normal breathing or blood circulation
- By pressure on the throat or neck, or by blocking the nose or mouth
- Classification
- A felony.
- History & circumstances
- No prior conviction is needed — it is charged on its own, unless a greater penalty applies elsewhere.
A separate felony. Confirm the exact charge and release conditions from court and custody records.
Minn. Stat. §§609.221–609.224
Other Serious Assault Allegations
- Allegations of substantial or great bodily harm
- Allegations involving a dangerous weapon
- Classification
- Ranges from misdemeanor to felony depending on the statute.
- History & circumstances
- The charging document controls which statute applies.
Other assault statutes may be charged with, or instead of, domestic assault. The GPS Assault Bail Bonds guide covers them.
Firearm Provisions — §609.2242, Subd. 3
Subdivision 3 sets firearm rules that apply after certain assault convictions against a family or household member — not at arrest or on posting bail.
- After a qualifying conviction, the court generally orders firearms transferred and informs the person of a possession ban (at least three years, longer in some cases).
- Amended by 2026 Minn. Laws ch. 75, §7: transfers must follow the §518B.03 transfer procedure, and permits to carry and purchase must be surrendered.
- Chapter 75 has no special effective-date clause, so the general August 1, 2026 start date likely applies — to be confirmed in attorney review.
- Ask a defense attorney how any firearm provision applies to a specific case.
Checked against the Revisor's text on October 11, 2026. Attorney review of this subdivision is pending.
This is general information, not legal advice. Statutory language can change — always check the current text on the Minnesota Revisor of Statutes website and speak with a criminal defense attorney about a specific charge.
Pretrial release
No-Contact Orders and Bail Conditions in Minnesota Domestic Assault Cases
Domestic assault cases often carry court orders that continue after release. These orders are separate from bail, and each one must be followed exactly as written.
Domestic Abuse No Contact Orders (DANCO)
Under Minn. Stat. §629.75, a court may issue a DANCO in connection with specified criminal proceedings, restricting contact or communication with a protected person.
Orders for Protection (OFP)
An OFP under Minn. Stat. §518B.01 comes from a separate civil protection-order proceeding. It is distinct from a criminal-case DANCO.
Conditional Release
Under Minn. Stat. §629.72, a judge may impose release conditions intended to protect affected people and ensure future court appearances.
No-Contact & Stay-Away Restrictions
Orders may prohibit direct or indirect contact, being at certain locations, or returning to a shared residence.
Firearm & Other Restrictions
Specific court orders and statutes can restrict firearm possession or other activities. The actual order controls.
What Posting Bail Does — and Doesn't
Posting bail addresses custody only. It does not cancel a DANCO, OFP or any other court-imposed restriction — every applicable order must still be followed.
DANCO vs. OFP vs. Pretrial Conditions
Three different kinds of court restrictions can apply at the same time. They come from different places, and none of them replaces another.
Minn. Stat. §629.75
DANCO
- Issued in the criminal case
- A separate order — independent of pretrial release conditions
- Can stay in effect even if release conditions change
Minn. Stat. §518B.01
Order for Protection
- A distinct protection-order proceeding
- Requested by a petitioner, not by the prosecutor
- Has its own hearings, terms and duration
§629.72 · Minn. R. Crim. P. 6
Pretrial Conditions
- Part of the judge's release order
- May include no-contact, monitoring or check-ins
- Apply only while the case is pending
Posting bail does not cancel any of these, and does not authorize contact. A protected person cannot set an order aside by agreement — only the court can change it.
Never contact a protected person, use someone else to communicate, or return to a residence in violation of an order. Ask a defense attorney or the court about any question on an order's terms.
Costs
How Much Does a Domestic Assault Bail Bond Cost in Minnesota?
There is no single bail amount for domestic assault. A court decides whether bail is set and how much; a bail bond producer then charges a premium based on the approved filed surety rate and Minnesota law.
Court-set bail amount
Set by the court for the individual case. GPS cannot set, lower or guarantee it.
Surety bond premium
The fee for the bond, based on the surety's approved filed rate. Generally not refundable.
Upfront premium payment
At least 50% of the premium on bonds of $10,000 or less, and at least 30% above $10,000, before posting.
Remaining premium
Where permitted, any balance must be paid within the time limits set by Minnesota law.
Collateral
Some bonds may require collateral, depending on the bond amount and underwriting review.
Cosigner responsibilities
A cosigner (indemnitor) may be responsible for the full bond amount if the defendant does not appear in court.
Cash Bail vs. a Surety Bond
- Cash bail: the full court-set amount is paid to the court. It may be returned at the end of the case, subject to court rules and deductions.
- Surety bond: when the court authorizes it, a licensed bail bond producer guarantees the full amount. You pay a non-refundable premium instead of the full bail.
- Court-ordered conditions such as no-contact orders or monitoring are separate from — and not part of — any bond premium.
Illustration only: Minnesota law sets a $100 minimum premium. Any calculator percentage is hypothetical — GPS confirms the actual premium in writing before anything is signed.

Payment
Minnesota Domestic Assault Bail Bond Payment Options
Minnesota Statutes Chapter 60M sets minimum rules for collecting bail bond premiums at the surety's approved filed rate. Any payment arrangement must fit within those rules.
Bonds of $10,000 or less
- At least 50% of the premium is collected before posting, with a receipt
- Any balance requires a signed promissory note and full payment within four months of posting
Bonds over $10,000
- At least 30% of the premium is collected before posting, with a receipt
- Any balance requires a signed promissory note and full payment within twelve months of posting
- These are legal minimums, not a promise of a payment plan. Eligibility depends on the bond, underwriting approval and the cosigner.
- Minnesota sets a $100 minimum premium. Promissory notes must use an approved form; annual interest cannot exceed 6%.
- Collateral and a cosigner may be required. No collateral-free arrangement or approval is guaranteed.
- GPS explains every cost and obligation before you sign anything.

Can You Get Bail for Domestic Assault in Minnesota?
It depends on the court's order, custody circumstances, release conditions and surety approval. Under §629.72, judges consider safety and court-appearance factors — a bail bond company never decides whether someone is legally released.
Has monetary bail been set?
The court decides whether money bail is set, and in what amount.
Is a surety bond authorized?
The court's order determines whether a surety bond is an allowed way to post bail.
Are there no-contact or protective orders?
A DANCO or OFP can apply alongside bail and must be followed after release.
Are there warrants or other holds?
A warrant, probation hold or detainer can prevent release even if bail is posted.
Is a hearing required?
Section 629.72 allows certain domestic abuse arrestees to be held for judicial review before release.
Can GPS and its surety approve it?
Separately from the court, GPS and its surety review each bond before agreeing to write it.
Release decisions belong to the court. GPS's decision to write a bond is a separate business decision based on underwriting.

Often, yes — but the court decides. A judge may hold the person for review under §629.72, release on conditions, or set money bail. A bail bond is an option only when money bail is set and a surety bond is allowed.
